Welcome to Pumpkin Bars. We respect the intellectual property rights of others and expect our users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for addressing alleged copyright infringement on our website and services.

Filing a DMCA Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Pumpkin Bars website or services, please notify our designated Copyright Agent as set forth below. To file a DMCA notice, your notification must be a written communication that includes substantially the following:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, and information reasonably sufficient to permit Pumpkin Bars to locate the material (e.g., URL(s) of the infringing material).
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Counter-Notification

If you believe that the material you posted on Pumpkin Bars was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. To file a counter-notification, your response must be a written communication that includes substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • Your name, address, telephone number, and email address.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the U.S., for any judicial district in which Pumpkin Bars may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
